An appeals court in Kansas has granted a victory to the LGBTQ community in the state, specifically trans residents who seek a gender change on their Driver's Licenses.
In July of 2023 a District Court blocked the state from accepting such changes after the legislature passed the Kansas Women's Bill of Rights which defined sex based on genitalia. For the past two years, Kansas licenses have had to match the user's sex listed at birth. This week, an appeals court lifted that prior ruling, allowing gender changes in licensing. It said the lower judge did not cite enough evidence.
The American Civil Liberties Union of Kansas represented five transgender residents in the case. In a statement, a Legal Fellow with the ACLU, D.C. Hiegert said the decision is a victory for the "personal autonomy, privacy and dignity of all Kansans."
The case can be appealed yet again to a higher judge.
