Iowa's new abortion law might not pass Constitutional muster

Constitutional law experts say the nation's strictest abortion law passed recently in Iowa likely will not have an easy path to the U.S. Supreme Court where supporters had hoped it would help end legalized abortion.  

The Iowa affiliates of the American Civil Liberties Union and Planned Parenthood filed a lawsuit this week challenging the constitutionality of a law set to go in effect on July 1 that would prohibit most abortions in the state once a fetal heartbeat is detected.  

The groups filed the lawsuit Tuesday in state court claiming the law violates Iowa's constitution rather than federal constitutional law.

That legal strategy likely is designed to avoid giving the U.S. Supreme Court a chance at reconsidering abortion precedent.
