Potential Plea Agreement in Tomarken Smith Murder Case

One of two Bethany, Missouri residents charged in connection with last fall's death of 21 year old Tomarken Smith of St. Louis may reach a plea agreement on September 3rd.

Smith died following an altercation last September 14th. 31 year old Kevin Mooney and 23 year old Tony Overlin were accused of assaulting Smith near the corner of Fourth and Market Streets in Maryville. The two were initially charged with second degree murder. According to Nodaway County Prosecuting Attorney Robert Rice...Mooney may agree to a lesser charge.

Rice says following the September 3rd hearing...sentencing is scheduled for Mooney on September 30th. Rice adds a plea agreement with Overlin has yet to be reached. Overlin's trial is set for November with pretrial motions scheduled for November 1st and the trial for November 12th.
