Supreme Court Ruling

The Missouri Supreme Court sides with a Linn County family suing after their husband and father was killed in a work-related accident.

In a 4 to 3 decision the justices ruled the case involving Lonnie Lewis should be given back to the lower court to be heard again. Lonnie's wife and daughter sued his former employer after the tractor trailer he was riding in overturned, killing him in 2004. The suit was brought against the owner of the trucking company because it didn't have workers' compensation liability insurance. Despite the lower court's ruling the civil action was barred because of an earlier settlement, the state's high court has ruled it can be heard again because previous cases in Missouri finding an employee or his dependents can't recover on both a civil suit and workers' compensation doesn't apply to this case because of the different employers involved.
