CHILLICOTHE, MO (2012-05-04)
A northwest Missouri man whose murder conviction was questioned by a judge is seeking his release from prison while the high court considers the case.
Mark Woodworth is serving a life sentence for his 1999 conviction in the death of neighbor Cathy Robertson 9 years earlier in her Chillicothe home. Woodworth was also convicted at a 1995 trial but briefly released after a successful appeal. Boone County circuit judge Gary Oxenhandler on Tuesday ruled that Woodworth, who was 16 at the time of the crime, was the victim of "A Manifest Injustice." He said Woodworth deserves either a new trial or release from prison after prosecutors failed to provide his lawyers with key evidence. On Wednesday, Woodworth's lawyer asked the Missouri Supreme Court to release him on bail.
