It could be several weeks before the Missouri Supreme Court issues its decision on a case from Linn county.
Staci Lewis and her daughter McCartney Lewis are suing the former employer of Staci's husband Lonnie, who was killed in 2004 when the employer's tractor trailer overturned and he was killed. The Lewis's are suing the owner of the trucking company because he didn't have workers' compensation liability insurance. Attorneys for the company argue, however, that the family has already been compensated through a worker's compensation award for a second company that hired the truck, which under Missouri Law bars them from also filing a civil suit against the truck's owner. The ruling by the Missouri Supreme Court could clarify the law for cases where people are suing for compensation for the same injury.
